Terms of Service

These terms are an agreement between you and Stijn ter Steege, based in the Netherlands ("Pingeon", "we", "us"), about your use of pingeon.page, the Pingeon app, the API and status pages (together, the "Service"). By creating an account or using the Service, you agree to these terms and confirm you've read our Privacy Policy. If you use Pingeon on behalf of an organization, you agree for that organization and confirm you're authorized to do so; "you" then means the organization.

1. Who can use Pingeon

You must be at least 16 years old and able to enter into a binding agreement. You may not use the Service if you're barred from doing so under applicable law, including sanctions laws.

2. The Service

Pingeon checks the availability of websites, servers, certificates, DNS records and scheduled jobs that you configure, notifies you by email when something seems wrong, and lets you publish a status page.

3. Your account

You sign in with one-time codes sent to your email address. Keep access to that mailbox secure: anyone who can read it can sign in to your account. You're responsible for activity under your account and must give us an email address you control. Tell us at [email protected] if you suspect unauthorized access. One person or organization may not create multiple accounts to get around limits.

4. Acceptable use

You may only monitor systems that you own or operate, or that you have permission to monitor. You agree not to:

5. Your content

"Your content" is what you put into the Service: monitor settings, incident notes, status page text and similar. You keep all rights to it. You give us a worldwide, non-exclusive, royalty-free licence to store, copy, process and display your content only as needed to provide, secure and improve the Service, for example to show your published status page to the public. This licence ends when you delete the content or your account, except for copies in backups, which expire within 14 days.

You're responsible for your content and confirm you have the rights needed to provide it. Status pages are public once you publish them: don't put anything on them that you don't want the world to see.

6. Other people's data

When you add other people's personal data to Pingeon, such as extra alert recipients, escalation contacts or the subscribers of your status page, you're the controller of that data and we process it on your behalf. Our Data Processing Agreement forms part of these terms and applies automatically. You're responsible for having a lawful basis for that data and for informing the people concerned where the law requires it.

7. Reporting illegal content

Anyone can report content on Pingeon (for example on a status page) that they believe is illegal or breaches these terms by emailing [email protected]. Please include: the exact URL, why you believe the content is illegal or breaches these terms, your name and email address (unless the report concerns child sexual abuse material), and a statement that you believe the report is accurate and complete in good faith.

We confirm receipt, review reports carefully and objectively, and decide without undue delay. If we remove or restrict content or an account, we'll tell the person affected and give our reasons, unless the law prevents it. Both the person who reported and the person affected can ask us to reconsider a decision by replying to our message; a person who did not make the original decision will review it. You may also use an out-of-court dispute settlement body certified under the EU Digital Services Act, or go to court. We may suspend accounts that frequently post manifestly illegal content, and stop handling reports from people who frequently submit manifestly unfounded ones, after a warning.

The same address, [email protected], is our single point of contact for users and for authorities of the EU member states, the European Commission and the European Board for Digital Services. We communicate in English and Dutch.

8. Suspension and termination

You can stop using Pingeon at any time and delete your account in Settings. We may suspend or restrict your account, a monitor or a status page, or terminate your account, if you seriously or repeatedly breach these terms, if your use creates a risk or legal exposure for us, other users or third parties, or if the law requires it. Where reasonable, we'll warn you first and give you a chance to fix the problem, and we'll always tell you the reason.

9. Intellectual property

The Service, including its software, design, the Pingeon name, logo and pigeon characters, belongs to us or our licensors and is protected by law. These terms don't give you any rights to them except to use the Service as intended. If you send us feedback or ideas, we may use them without any obligation to you.

10. Disclaimer

To the extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise that the Service will be available, uninterrupted, secure or error-free, or that any check or alert will happen or arrive. Pingeon is a monitoring aid, not a guarantee: don't rely on it as your only safeguard for systems where a missed alert could cause injury, damage or loss. Nothing in these terms limits rights you have as a consumer that can't be waived by contract.

11. Exclusion of liability

The Service is provided free of charge and you use it entirely at your own risk. To the maximum extent permitted by law, we're not liable for any damage or loss of any kind arising from or relating to the Service or these terms, whether in contract, tort (including negligence) or otherwise. This includes direct, indirect and consequential damage, loss of profit, revenue, data or goodwill, and damage caused by checks or alerts that are missed, late or incorrect, by downtime of the Service, or by the content of status pages.

This exclusion doesn't apply where the law doesn't allow liability to be excluded, such as for damage caused by our intent or deliberate recklessness, for death or personal injury, or under mandatory consumer or data protection law. In those cases we're only liable to the extent the law requires.

12. Indemnity

If you use the Service for business purposes, you'll compensate us for reasonable costs and damages arising from third-party claims caused by your content or by your breach of these terms or the law. This section doesn't apply to consumers.

13. Changes to these terms

We may update these terms, for example when the Service or the law changes. For material changes, we'll email account holders at least 30 days before they take effect. If you don't agree, you can delete your account before then; continuing to use the Service after the effective date means you accept the new terms. Changes required by law or for security may take effect sooner.

14. Governing law and disputes

These terms are governed by the laws of the Netherlands, excluding the UN Convention on Contracts for the International Sale of Goods. Disputes go to the competent court in the Netherlands. If you're a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring proceedings in the courts there. Please contact us first: most problems can be solved by email.

15. General

These terms, the Privacy Policy and the Data Processing Agreement are the whole agreement between you and us about the Service. If a provision is invalid, the rest stays in force and the invalid provision is replaced by a valid one that comes closest to its intent. If we don't enforce a right, we haven't waived it. You may not transfer your rights under these terms without our consent; we may transfer them to a successor of the Service, in which case we'll tell you in advance. The English version of these terms prevails over any translation. Questions: [email protected].
